Wouter Vandorpe is a lawyer (Of Counsel) in the Energy & Utilities Practice of Fieldfisher LLP Brussels. He advises enterprises and authorities primarily on energy law related matters, amongst which on electricity and gas market regulations, renewable energy projects, energy efficiency related issues, legislation on energy performance of buildings, drafting of energy contracts, and drafting of regional legislations. He also advises on specific legal issues in the domains of climate, waste and water law. He regularly acts before the Belgian Council of State and Constitutional Court, and the European Court of Justice.

Interconnections & Wind: How will new interconnection developments change the EU wind energy industry?
A key topic on how the EU energy markets should become more harmonised and integrated, is in what way interconnection points and capacity reservation on these points must be more developed.
The capacities of interconnections and the (harmonised) regulation of the specific tariffs for use of these interconnections between Member States, shall determine in practice whether Member States shall be effectively interconnected or not, and whether free energy flow across Member States is possible.
Legal uncertainty of "technical" issues such as loop flows and bidding zones currently hamper better interconnections. Also, it is to be pointed out how transmission system operators controlling the interconnections and bidding zone activities will be incentivised (or compelled) to make more investments in interconnection capacity (& resolve legal hurdles)?
The possibilities and (legal) constraints of developing interconnections on an EU scale directly impacts the wind energy industry: eg the hypothesis that a Danish wind park can produce for delivery to a French consumer (or the other way around), through transparent and affordable interconnection, seriously influences the EU wide strategy.
The author's approach is to point out the actual legal status of interconnections under EU law, the current (policy) discussions on this subject and how this could influence the positioning of the wind energy sector across the EU.
The above will be benchmarked through discussions with various regulators, system operators and the EU institutions.
The author would further give a number of case-specific examples on how the current interconnection status could influence the wind industry, and how it is envisaged to change.

The author envisages coming to the following conclusion on the influence of interconnections on the wind energy industry: The current envisaged adaptations to the interconnection for increased capacity and use, in order to create a more EU (or regional) electricity market, must be taken into account in future strategic decisions on wind energy for developers.
The author will present suggestions to the wind industry how to take into account this issue in its decisions and business plans, via specific parameters.
The author seeks to demonstrate to the delegates how, from a legal perspective, the envisaged interconnection modifications (and the current status thereof) could influence their strategic decisions in the wind energy sector.
